The court also rejected Merck’s invalidity arguments, according to Halozyme. Intravenous Keytruda is not covered by the order.

The October 7 ruling is a high-value source-gap catch-up within the active 36-hour window. It converts a delivery-platform patent dispute into an immediate launch constraint, but it does not resolve the broader global litigation. Appeal, country-specific enforcement, product-routing changes, redesign, licensing, and the separate U.S. case remain open.

The Hague court’s injunction applies through MSD BV, Merck’s central European marketing-authorization holder and packaging and distribution hub, and covers Belgium, Denmark, France, Ireland, Italy, Sweden, Switzerland, and the Netherlands. It also restricts facilitation of infringement by affiliates through the European marketing authorization. A prior preliminary injunction has blocked launch in Germany since December 2025.

Halozyme distinguishes the asserted MDASE patents from its ENHANZE licensing estate. The company says the dispute therefore does not change existing ENHANZE licensees’ rights or fees. Halozyme has also filed a U.S. federal case alleging that Keytruda QLEX infringes 15 patents. Merck’s counterarguments and appellate position were not independently available in the same primary disclosure.

Deep Analysis

Subcutaneous reformulation is strategically important late in a blockbuster biologic’s lifecycle because it can shorten chair time, shift care settings, reduce infusion infrastructure, and defend share against competing regimens. The injunction shows that route-of-administration innovation can carry an IP dependency comparable with the active antibody itself. The competitive issue is not whether pembrolizumab remains available; intravenous Keytruda does. It is whether Merck can deploy the convenience and capacity advantages of its SC formulation on its intended timetable.

The scope is operationally amplified by MSD BV’s central role. A prohibition on manufacture, packaging, distribution, or facilitation from a hub can affect multiple national launches even though patent enforcement is territorial. The exact commercial effect will depend on existing inventory, implementation dates, appeal stays, alternative supply routes, and how marketing authorizations are structured. None should be inferred from the injunction headline alone.

MDASE and ENHANZE represent distinct technology and IP paths. Halozyme’s statement that current ENHANZE licenses are unaffected is important because an expansive reading across its licensed estate could create partner uncertainty. At the same time, enforcement success could strengthen Halozyme’s negotiating position for non-ENHANZE high-volume SC products. That is an inference, not a disclosed transaction outcome.

The strongest counterargument is that patent injunctions can be narrowed, stayed, reversed, designed around, or settled, and that IV availability limits immediate patient-access consequences. Merck may also prioritize markets not covered by the order or alter manufacturing and authorization arrangements. The ruling therefore signals leverage, not final control of the category.

For platform builders, the translational lesson is that enzyme sequence, formulation, concentration, device performance, tissue dispersion, immunogenicity, manufacturing, and freedom to operate must be developed together. A technically successful formulation without durable IP clearance can fail at launch, while an enforceable platform estate can create value beyond direct licensing revenue.

Company and Product Background

Pembrolizumab is a PD-1 checkpoint inhibitor used across multiple cancers. Subcutaneous formulations are intended to reduce administration time compared with intravenous infusion, but high-dose antibody delivery requires solutions to concentration, viscosity, tissue dispersion, and device constraints.

Halozyme develops hyaluronidase-based and hyperconcentration technologies for subcutaneous biologic delivery. Its MDASE patent family is separate from the widely licensed ENHANZE platform, according to the company.

Signal Extraction

Verified facts: the Dutch court found infringement of EP622 and issued an injunction covering eight named markets; it rejected the invalidity arguments described by Halozyme; Germany was already subject to a separate preliminary injunction; IV Keytruda remains available.

Company claim: MDASE enforcement will not affect ENHANZE licenses or fees. The contractual and patent-estate separation is plausible but has not been independently adjudicated in this disclosure.

Interpretation A: the order gives Halozyme material licensing or settlement leverage. Support includes the multi-market scope and central-hub restrictions. Contradiction: appeal, redesign, or alternative logistics may reduce leverage.

Interpretation B: the order is a temporary regional obstacle with limited franchise effect because IV pembrolizumab remains available. Support is continued IV access and the unresolved appellate path. Contradiction would be durable injunctions across additional jurisdictions or licensing on economics that validate the asserted estate.

InSilens Take

This is a material technology-platform signal because it demonstrates that delivery IP can delay commercialization of an already approved therapeutic franchise. Direction is positive for Halozyme’s enforcement position and negative for the timing of Merck’s SC launch in the covered markets, but the global economic outcome remains uncertain.

Upgrade evidence includes appellate affirmation, enforcement in additional jurisdictions, or a disclosed license or settlement. Downgrade evidence includes a stay, invalidation, non-infringing redesign, or operational rerouting that restores launch without material economics to Halozyme.

Signal Assessment

Signal Importance: 4 of 5. Signal Direction: positive for Halozyme; negative for Merck SC timing. Confidence in Facts: high for the disclosed order. Confidence in Interpretation: moderate.

A specialized Dutch court found that Merck’s subcutaneous pembrolizumab product infringes Halozyme’s MDASE patent EP 2,797,622 and ordered MSD BV to stop specified manufacturing, distribution, marketing, use, import, and stocking activities tied to Keytruda…

[4
996,997,998,123,999,522
post-3670","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-technology-modalities","tag-halozyme","tag-keytruda-sc","tag-mdase","tag-merck","tag-patent-litigation","tag-pembrolizumab
["GET
